Terms of Use
These terms cover your use of the unClick app and our website. They're written to be readable. Please read them.
01 Acceptance
By downloading, installing, or using the unClick software ("the App"), or by using this website, you agree to these Terms of Use. If you don't agree, please don't use the App or the website.
These terms are between you and Ground Glass Technologies LLC, an Illinois limited liability company ("Ground Glass Technologies", "we", "us", or "our"), the publisher of unClick ("unClick", "the App", "the Service").
02 License to Use the App
Subject to these terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the App on devices you own or control, for your own personal, non-commercial use.
You agree not to: copy, modify, reverse engineer, decompile, or attempt to extract the source code of the App; rent, lease, sell, sublicense, or transfer your rights in the App; remove or alter any proprietary notices; or use the App in any way that violates applicable law.
03 Your Account and Access
Access to the App is personal to you and non-transferable. You are responsible for activity under your account and for keeping any credentials secure.
We may suspend or terminate your access at any time, for any reason, with or without notice, including for violations of these terms.
04 Your Feedback
We're grateful for your feedback. Crash reports, comments, suggestions, screenshots, written notes, and other feedback you send us (collectively, "Feedback") are incredibly valuable.
By giving us Feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate it into the App or any other product, without compensation or attribution. You confirm that your Feedback is yours to give and doesn't include anything confidential to anyone else.
05 Intellectual Property
The App, its design, code, and all related content are owned by Ground Glass Technologies LLC and its licensors, and are protected by U.S. and international intellectual property laws. The underlying technology is the subject of United States provisional patent applications. Nothing in these terms transfers any ownership to you.
You keep full ownership of any photographs you take with the App. The App doesn't claim any rights in your photos.
06 Data and Privacy
The App may collect anonymous performance data, crash reports, and usage analytics to help us improve it. Photos stay on your device unless you explicitly share them. We don't upload your photos anywhere.
Your privacy is important to us. Our collection, use, and disclosure of personal information is described in our Privacy Policy. By using unClick or this website, you acknowledge and agree to the practices described in our Privacy Policy.
07 No Warranty
The App is provided "AS IS" and "AS AVAILABLE", without warranties of any kind.
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and uninterrupted or error-free operation. We do not warrant that the App will be free of bugs, errors, or interruptions, or that any defects will be corrected. No advice or information you get from us creates any warranty not expressly stated here.
Don't use the App as your only camera at a wedding, a birth, a once-in-a-lifetime event, or any other moment you can't recreate. Keep a backup for anything that matters.
08 Limitation of Liability
To the maximum extent permitted by law, Ground Glass Technologies LLC, its officers, members, managers, employees, agents, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or photos, arising out of or in connection with your use of the App, whether based on warranty, contract, tort, or any other legal theory, and whether or not we've been advised of the possibility of such damages.
Our total aggregate liability to you for all claims related to the App or these terms is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) twenty U.S. dollars ($20).
09 Indemnification
You agree to indemnify, defend, and hold harmless Ground Glass Technologies LLC, its officers, members, managers, employees, agents, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your misuse of the App, your violation of these terms, your violation of any law or third-party right, or content you submit through the App.
10 Termination
These terms apply as long as you use the App. You can stop using it anytime by uninstalling. We can terminate your access at any time for any reason, including for violation of these terms.
The following survive termination: Feedback (section 4), Intellectual Property (section 5), No Warranty (section 7), Limitation of Liability (section 8), and Indemnification (section 9).
11 Changes
We may update these terms from time to time. If we do, we'll post the updated version on this page and update the "Effective" date at the top. Material changes will be communicated where reasonably practical. Continuing to use the App after changes means you accept them.
12 Governing Law
These terms are governed by the laws of the State of Illinois, United States, without regard to conflict of laws principles. Any dispute will be resolved in the state or federal courts located in Cook County, Illinois, and you consent to that jurisdiction.
